Court of Appeal to hear arguments for banning transgender health care for state employeesThe US Court of Appeals for the Fourth Circuit will hear oral arguments Wednesday at <a href="https://pulse.ncpolicywatch.org/2019/03/11/state-employees-file-lawsuit-over-transgender-discinction/ " rel="nofollow noopener" target="_blank"> A case in which the state was found to have violated the rights of state employees and their families with a blanket exclusion of gender-affirming care for transgender people under the state health plan. </a> Last year a federal judge in Winston-Salem ruled that the ban violated the Equal Protection Clause of the US Constitution and Title VII of the Civil Rights Act of 1964 by discriminating on the basis of gender and transgender status. Folwell, on behalf of eight plaintiffs—current and former government employees and their children—who were denied coverage under the state health plan. Transgender patients and their doctors have testified before the plan’s board of trustees that the treatment is necessary and lifesaving. Gender dysphoria and the transition-related care to treat it are recognized by the American Medical Association and the American Psychological Association as medically necessary and potentially lifesaving. Countless medical professional organizations have called for an end to transgender-focused exclusion in public and private health insurance policies. Despite this, Folwell continued to describe care as elective and to focus only on surgeries, only one part of transgender health care the blanket exclusion of families has prevented from accessing it. Many transgender people choose not to have any surgery related to their transition. The blanket waiver not only excludes surgical procedures, but covers all treatments related to gender dysphoria — including things like hormone therapy and even talk therapy. Similar treatments available to non-transgender patients are covered under the plan. “Until the court system, or a legislature or constituents tell us that we should,” and “when,” and “how” to spend taxpayer money on sex reassignment surgery, I will not make a decision that would discriminate, Folwell said in the statement shortly after the announcement. Filing the original lawsuit, the court issued a clear injunction, but Folwell’s office continues to fight it. “The trial court ordered a permanent injunction, requiring the plan to provide care,” Borelli said. “The defendant sought to stop that order twice, first in lower court and then Again in the Court of Appeal. Both courts denied this request. So the permanent injunction remains in full force and we’re optimistic that the injunction will be upheld once.
